By accessing and/or using www.myAMP.co.nz (or any sub-domains of these website addresses) “the Website”, or any section of it, you agree to be bound by the Terms and Conditions set out below. These Terms and Conditions are in addition to, and do not replace, any specific terms and conditions applicable to any AMP product or service and to the extent that there is any conflict between these Terms and Conditions and those of AMP’s products and services, the terms and conditions of the specific products and services will prevail. AMP may vary these Terms and Conditions at any time without notice and your continued use of this website following any such changes indicates your acceptance of those changes.
In the Website, a reference to AMP, AMP New Zealand, “us”, “we” or “our” is a reference to any and/or all of AMP Wealth Management New Zealand Limited and AMP Life Limited or an associated New Zealand company of those companies, as the context requires.
Information on the Website, including the risk profiler and calculators provided on the Website, is general in nature only. Information, the risk profiler and calculators on the Website should not be your only source of information and should be treated as a guide only. They do not constitute personalised financial advice to the extent that any content on the website consitutes financial advice, it is class advice only. Where performance figures are shown, they are shown in accordance with the specific terms, conditions and assumptions stated. AMP does not guarantee the continued availability of the Website or the continuation of any services provided on it (including SMT Portal) and access to the Website may be interrupted, restricted or delayed from time to time. AMP does not accept any responsibility or liability in relation to any loss suffered in these circumstances. You agree to follow any instructions supplied to you in relation to the use of the Website (including SMT Portal) and you agree not to use, or permit to be used, the Website for any illegal or improper purpose. You indemnify AMP for any loss incurred or damage suffered by us or any other party resulting from your use of the Website or failure to take reasonable steps to prevent illegal or improper use of the Website.

The information on the Website is intended for residents of New Zealand only and any products and services offered on the Website are only offered to New Zealand residents living in New Zealand. These Terms and Conditions are governed by New Zealand law and are subject to the exclusive jurisdiction of the New Zealand courts. References to $ or dollars mean New Zealand currency unless otherwise specified.

When you visit the Website (other than the SMT Portal section of the Website) you may do so anonymously. AMP does not collect your name, email address or other personal information when you access or use the Website unless you choose to provide it to us voluntarily or if we explicitly ask for this information (for example in the SMT Portal section of the Website (see below), or to authenticate you as part of login procedures, or for promotional purposes). We do, however, collect data to help us determine which pages are most popular, peak usage times and other information that helps us make the Website easier and more efficient for you to use.

AMP uses “cookies” as a method of registering user-preferences, to help enhance and personalise your experience on the Website. AMP is an agency for the purposes of the Privacy Act 1993. All personal information that you supply to AMP, on the Website or otherwise, will be treated in accordance with that Act. AMP collects, stores and uses any personal information that you do supply in order to comply with certain laws and regulations and to provides you with services including, without limitation: administering the Website and enforcing the rights of AMP under these Terms and Conditions; marketing goods and services provided by AMP; administering your policies or products; keeping your records up-to-date; developing and improving our products and services; enabling you to communicate with AMP; and providing you with information regarding your investment(s) with AMP and other AMP products and services. You agree that we may use any information that you provide us with to keep you informed and up-to-date with reports, statements, newsletters and details of products and services and to provide you with additional information about the full range of products and services we offer.

You have the right to ask to see information AMP holds about you and if you believe the information is incorrect to ask that it be corrected. Further information about privacy and the New Zealand Privacy Act is provided by the Office of the Privacy Commissioner (www.privacy.org.nz).

SMT Portal
Certain AMP customers can use the SMT Portal section of the Website to login to online information on their investments in AMP Retail Superannuation, AMP Business Superannuation, ASPIRE SSRSS and/or the AMP Wealth KiwiSaver Scheme.

SMT Portal is an internet-based service accessed via use of a user name and confidential password/s. It enables existing AMP Retail Superannuation, AMP Business Superannuation, ASPIRE SSRSS and AMP Wealth KiwiSaver Scheme members to access certain information about their investments in these products. To register for a SMT Portal account you will need to have access to the internet. While AMP endeavours to provide a secure system via the internet, you are responsible for your own anti-virus measures and security precautions to prevent unauthorised use of and access to SMT Portal and to protect your personal information.

When you visit the SMT Portal section of the Website we ask you to register your name and email address with us and set a cookie on your machine (this is a small piece of information stored on your computer’s hard drive and/or memory) so when you next visit SMT Portal it links you to the personal information about you that is stored on our system. You will not be able to operate SMT Portal unless cookies are enabled on your computer.

You acknowledge that access to your SMT Portal account will be provided to any person using your user name and password/s. It is therefore very important that you keep your user name and password/s secure and personal to you only. No other person, including your adviser, should be given access to your user name and password/s. Never write them down or include them in an email. Remember that protecting your user name and password/s is your responsibility. If you forget this information AMP will use appropriate procedures to authenticate you and reset your password.

Any action or request made by a user of your user name and password/s will be deemed to have been made by you and you will be responsible for such actions and requests and the request may be carried out by AMP without further enquiry. AMP is entitled to treat any information received via your SMT Portal account as reliable, accurate, complete and up-to-date.

You will notify AMP in writing if you require your access to SMT Portal suspended or cancelled at any time. You will remain responsible for any actions on your SMT Portal account up until the time of suspension or cancellation. We may withdraw your SMT Portal access at any time, provided you have been given reasonable notice in the circumstances. We may suspend or withdraw your SMT Portal access at any time without prior notice if you have breached these Terms and Conditions; we learn of your death, bankruptcy or lack of legal capacity; we are notified by any party of a dispute over either ownership funds or the operating of the account; or we, in our absolute discretion, consider that we have other reasonable grounds to do so.
